General Rule for Obtaining Georgian Tax Residency
Under the Georgian Tax Code, an individual is considered a tax resident for the current tax year if they are physically present in Georgia for at least 183 days during any continuous 12-month period ending in that year. This rule applies equally to Georgian citizens, foreign nationals, and stateless persons.
Certain periods of presence are excluded from the calculation, including time spent in Georgia in a diplomatic or consular capacity, as an employee of an international organization under an international treaty, while transiting from one foreign country to another, or for medical treatment or vacation.
High Net Worth Individual Tax Residency
Georgia’s tax legislation provides an alternative pathway for individuals who may not meet the 183-day physical presence requirement.
A High-Net-Worth Individual is defined as a person whose verified worldwide property exceeds 3 million GEL, or whose annual income over each of the last three years exceeds 200,000 GEL.
Qualifying individuals may be granted Georgian tax residency based on their economic ties to Georgia, even without prolonged physical presence, in accordance with the rules established by the Minister of Finance.
Key Eligibility Requirements
To qualify for Georgian tax residency under the HNWI program, an applicant must meet the following requirements.
First, the applicant must have either verified worldwide property exceeding 3 million GEL or annual income exceeding 200,000 GEL in each of the previous three years.
Second, the applicant must own property in Georgia worth at least the equivalent of USD 500,000 in GEL.
Third, the applicant must meet one of two alternative conditions. The applicant must either hold a valid Georgian residence permit, residence card, or Georgian citizen’s ID card, or, alternatively, must have received at least 25,000 GEL in Georgian-source income during the tax year preceding the application.
These requirements are designed to demonstrate both a substantial financial position and a meaningful economic connection to Georgia.
Application Process for HNWI Tax Residency
Applications for HNWI tax residency are submitted to the Revenue Service either in person, through an authorized representative, or electronically.
Applicants must provide the supporting documents required under the applicable rules, including evidence of their wealth or income, property valuation documents, and, where applicable, evidence of Georgian-source income.
If the Revenue Service determines that the application and supporting documentation meet the applicable legal requirements, it must forward the case to the Minister of Finance of Georgia with a proposal to grant tax residency within seven working days.
Where deficiencies are identified, the applicant is notified and given up to 30 days to correct them. If the deficiencies are not corrected within this period, the application is treated as withdrawn. The applicant may submit a new application at a later date.
HNWI tax residency is granted on an annual basis. Accordingly, renewal requires the submission of updated documents demonstrating continued compliance with the applicable requirements.
